Fair Use Policy

The use of the FindNFund Platform by the Member's End Users is the Member's responsibility.

By way of example (but not limited to), an End User must not (a) take any action or (b) upload, download, post, submit, share, or otherwise distribute—nor facilitate the distribution of—any content on or through the FindNFund Platform that:

• infringes any patent, trademark, trade secret, copyright, publicity right, or other (intellectual property) right of any natural or legal person (including FindNFund), or violates any legal or contractual obligation;
• is known by the End User to be incorrect, misleading, untruthful, or inaccurate;
• constitutes illegal content as defined in Article 2(g) of Regulation (EU) 2022/2065 (Digital Services Act, "DSA"), or otherwise violates applicable law;
• contains unauthorized or unsolicited advertising, junk mail, or bulk email ("spam");
• involves commercial activities (whether or not for profit) and/or sales, other than through appropriate use of an invitation URL, without FindNFund's prior written consent;
• contains software viruses or any other computer code, files, worms, logic bombs, or programs designed or intended to disrupt, disable, damage, limit, or interfere with the proper functioning of any software, hardware, or telecommunications equipment, or to damage or gain unauthorized access to any system, data, password, or other information of FindNFund or any third party;

or

• contains identification documents or sensitive financial information;

or allow any third party to do any of the above.

In addition, an End User must not (directly or indirectly):

• use the FindNFund Platform in any way that compromises the integrity, security, or continuity of FindNFund's systems;
• resell or further distribute (parts of) the FindNFund Platform in any manner;
• send unsolicited messages to FindNFund and/or any third-party recipient;
• interfere with, or attempt to interfere with, the proper functioning of the FindNFund Platform or any activities conducted through it;
• bypass or circumvent measures used by FindNFund to prevent or restrict access to the FindNFund Platform (or to other accounts, computer systems, or networks connected to it);
• use manual or automated software, devices, scripts, or other processes to "crawl" or "spider" any pages of the FindNFund Platform;
• modify, copy, mirror, scrape, adapt, reproduce, distribute, translate, create derivative works from, disclose, further publish, reuse, sell, trade, or otherwise exploit the FindNFund Platform in any way;
• otherwise act in violation of these Terms.

To the extent permitted by law, the End User shall indemnify and hold FindNFund harmless against any third-party agreements between End Users and any third-party claims (including settlement costs and reasonable legal fees) arising from any use of the FindNFund Platform by the End User that violates these Terms, applicable law, or is otherwise unlawful.
